Individuals who were notified by OSF HealthCare that their confidential Personally Identifiable Information (“PII”) or Protected Health Information (“PHI”) may have been compromised in a Data Incident that occurred between March 7, 2021 and April 23, 2021 may be eligible for a payment from a class action settlement.
- A settlement has been reached with OSF HealthCare System (“OSF”) in three class action lawsuits (the “Lawsuits”) arising from a Data Incident (the “Data Incident”) that occurred between March 7, 2021 and April 23, 2021. OSF first announced the Data Incident on or about October 1, 2021 and began mailing notice letters to patients whose information was identified as being impacted. Following notice of the Data Incident, the Lawsuits were filed against OSF asserting claims arising from the Data Incident. OSF denies it has any liability for the claims asserted in the Lawsuits and contends that it did not engage in any improper conduct.
- In the Lawsuits, Plaintiffs allege that OSF was the target of a Data Incident in which an unauthorized third party accessed OSF’s systems which contained personal information. Plaintiffs allege that during the Data Incident, an unauthorized third party gained access to Personally Identifiable Information (“PII”) and/or Protected Health Information (“PHI") belonging to Plaintiffs and other similarly situated OSF patients. The PHI and PII may have included names, dates of birth, medical records and patient account numbers, health insurance information, treatment information such as diagnoses, medications, providers, types of treatment, treatment locations, and in some instances, social security numbers or driver license numbers.
- The Settlement Class includes all individuals whose full name and other PII and/or PHI was potentially accessed during the Data Incident.
- All Settlement Class Members will receive the opportunity to claim two years of credit monitoring services through Pango from the date of enrollment. You must file a Claim Form requesting the service and, after the settlement becomes final, you will be provided an activation code for enrollment directly with Pango. The credit monitoring services include: (i) credit monitoring; (ii) dark web monitoring; and (iii) identity theft insurance of up to $1,000,000.
- The settlement also provides the following: (i) cash reimbursement of up to $20 per hour (for a maximum of 3 hours) as compensation for time lost dealing with the Data Incident, (ii) up to $500 per person for documented “ordinary expenses” incurred in responding to the Data Incident, and (iii) reimbursement for documented “extraordinary expenses” incurred in responding to the Data Incident. The maximum amount that can be claimed for lost time and ordinary losses is $500 in total.
- You must file a Claim Form to receive Credit Monitoring or one or more of the compensation categories provided for under the settlement. You can file a Claim Form by submitting a claim online, downloading a Claim Form and mailing it, or you may call 1-844-403-1014 and request that a Claim Form be mailed to you. The last day to postmark or file a claim online (“Claim Deadline”) is December 15, 2022.
